I'm saying that if you aren't prepared to do something about it, it's legal. It may be shady, but what are you going to do? If you support the mix forum, you support the Ebay poster. pretty clear.

look at the price... hardly the cost of a CD init. he's selling a CD that happens to contain data. market it that way and nobody says anything legally. sad but true.

I disagree. Your rationale of "since no one is willing to do anything about it, its legal" is flawed. Its illegal, as you yourself pointed out in an earlier post. Regardless of if someone is gonna do something about it, it is. If its not, your lawyer fed you a bunch of BS.

DJ Mixes have long been an acepted way for DJs, artists and labels to promote. With the exception (rightfully so) of all label mixes, i.e. all Deep Medi or all DMZ, most labels only get upset when you try to sell them. Supporting the mix forum does not support this guy. Quite the opposite in my opinion.

By the way, CDs cost about 10 cents. He's charging the equivilant of about $3 US. Not exactly raking it in hand over fist, but he is making a 3000% profit on about 3mins worth of work.

If he was smart about it, he would be selling the "cloth CD sleeve" that the cd comes in and giving the cd away for free.

Well technically those DJ mixes, even non label mixes are illegal. Accepted or not. You can scan ebay for bootlegs of various pop concerts as well. They are being sold there. Nobody wants to accept my definition of illegal, which is actually the real definition, because they won't consider that just because nobody has been busted for it yet they won't be(they have in fact busted DJ's in clubs doing this before, just so you know, I'm not pulling it out of my ass).

Is it wrong, yes.. is it illegal, yes... according to your definition is it illegal? Not any more illegal than the mix forum. Ask any music blog owner what "the artist gave me permission" means...

Case closed. You could produce a tune, if there is a single unlicensed sample in that tune YOU don't have any rights to transfer. That's the law.

Go check out the mix forum. Welcome to that Ebay auction. Technically if you didn't produce the track, even if you bought it on vinyl you have no legal right to play the track in a mix, or live if you want to wax philosophical about it.

That doesn't matter. You don't purchase performance rights when you buy a CD, correct? This material may not be broadcast, performed, etc... read the fine print next time you buy a CD. You purchase a license to listen to and make one copy of for personal use. You have no right to distribute, or otherwise share, including derivative works. I'd be happy to have my lawyer explain it. Fear not, you can most assuredly play the living piss out of our records that come from our label. But if we wanted to be assholes, we could legally put a stop to it. Ask any major club owner who has to pay royalties out the ass just to stay in business.
