Yes, Burial did not get any action taken against him, but look at all the artists who have? What about that guy who used the Faxing Berlin loop that came with FL Studio, and faced legal action. Certainly that artist was not big either, yet Deadmau5 himself ended up finding it.
And a lot of music uploading sites don't allow songs uploaded with uncleared content, Bandcamp being an example. I know when uploading to iTunes that you must agree that you own the content in your song. You could ignore these rules (and laws) and just do as you please, but that doesn't exactly scream professionalism.
As for "twisting the samples up", I wasn't suggesting that makes them ok to use, it just makes it less likely that you will get caught.
I'm not here to debate about this, because getting caught or not getting caught aside, it is still illegal. I just want the OP to know what he is doing, because I would like to be aware if I were in his situation.
