Legal issues and royalties.

Post by Dankstep » Mon Jul 09, 2012 5:44 am

So one of my good friends is a rap producer, he just makes rap instrumentals. Some dudes took one of his beats without paying, and the song is on the radio now. And he hasn't received a dime. He was trying to say that once you export your intstrumental, to say mp3 for example. That it's copyrighted already at that point because you have the project file? I've never heard this, this certainly can't be true?

What can he do? Shit sucks..

If it's your friend's original creation, then it's copyrighted. Did he try to contact the artist / his manager or the radio station about it?

Are you sure? You don't have to file a copyright for it yourself? Does it matter or not that his FL studio is pirated?

He's gotten in contact and they took the song off youtube and radio for now until they pay him.. But what about the money they made from when it was playing?

I'm also trying to help him getting a better contract agreement written.. Is there any like templates or good ones I can just copy and paste to use as a base and then tweak it more to meet his needs? And should he force them to pay up front no questions asked?

If he's going to receive a percentage of the royalties from their composition, and is registered with your Australian Performing Rights Association equivelent, the royalties might be paid every 6 months, so he might still recieve it.

I am not a lawyer, though.

So he has no problem stealing from others, but gets upset if people steal from him? I don't see anything wrong with that

Contact their manager about the copyright. It doesn't matter if your FL is pirated or not. All the new rap producers have pirated FL.

Depends where he is. That is true for some places though, UK for example copyright is automatic when something is created.
Tell him to buy FL tomorrow.
