when did everyone get so negative? when california was voting on it in 2010 i was the bad guy for saying that it was poorly written because everyone was in a hurry to get the ball rolling...

it's as if none of you have cracked a US history book... check out the 18th/21st amendments and how a grassroots state-by-state effort overturned a federal law thirteen years after it was put into place. it's a strikingly similar pattern of progress on the micro scale to what is happening now, except more drastic (a repeal of an amendment to the constitution itself)

I'm a wee neg because the bills themselves, I think are pretty flawed in practical ways, I'm sure you agree on that one. But then, as you see a growing trend of states medicalizing and now recreationalizing (honestly wow on this, really didn't think I'd see this in my lifetime, really, seriously) mj, you also see a growing resistance on the federal level, which results in more people's lives ruined, more people living in fear, and more people working and living in the shadows. AND then, there is the illegal prosecution of mj related people. That really, really gets me, because the dream (which is being realized) was that you change the laws, and then the insanity will be over, millions can leave the prisons, or not live in fear of the prisons, but no, even with the law changed, people will still have their doors kicked in, guns to their heads... swhat is bumming me out, really.

The whole state law/federal law thing is so confusing. Surely if it's a state law and the DEA have federal law authorisation to still fuck folks shit up, its gonna be really embarrassing for the state law authorities?

That's how it works.
It's why you have so many people siding with libertarians, or that "crazy" Ron Paul since they want these big issues such as this, abortion, gay marriage etc to be state rights issues not to be superseded at the federal level, especially since neither of the major parties will address the issues.
Notice how this was a major issue in 3 states passing laws to legalize marijuana and passing in 2, yet in the national GOP and DEM debates not brought up once, but at the third party debates they actually asked the question about the war on drugs and reform of the laws such as these and the candidates covered it extensively.

likely because a president doesn't have anything to do with introducing the federal laws that would require the DEA and Justice department to stop pursuing them.

Someone has to start the precedent somewhere otherwise there really is no point to state law, or the concept of states.
For example alcohol isn't illegal at a federal level, but there are dry counties within states which prevents the sale of any alcohol. Jack Daniels is manufactured in one of these counties, meaning they can make it there, but not sell it.

The whole State vs Federal law thing always fucks with my head. Are Supreme courts federal then? And if State law is passed but the Feds raid somewhere, does that mean the State politicians are held accountable (as they passed the state law?). What are the proposed benefits of such as system? I mean if a State set a law and the Feds just override it, what's the point in the State law system anyway?

I guess it has it's equal with the EU vs Member States law system, but thats more related to tax, agricultural and cross border relationships rather than individual country laws.

Heh this will do your head in a bit more, there are state supreme courts, and a federal level supreme court. As far as accountability the state legislators will never take the blame, just the people who break a federal law if prosecuted under it. It makes for interesting litigation in all honesty which is what lawyers should be doing rather than all the frivolous crap.

Take same sex marriage for example, at a state level it is legal in say Massachusetts, but the couple can't file their federal taxes as a married couple, I'm unsure if they are allowed to at a state level though.

Another point that I don't think has been brought up in this thread is what is going to be the fate of those previously convicted on possession, growing, or sale of just marijuana that are sitting in a cell atm?
Is the law coming into effect going to be retroactive and get them released?
