how do "we know they´re up to no good" if they don´t even need to provide any little bit of evidence, if there is no public debate and if the decision will always be made behind closed doors?

that's why democracy is the best regime we came up with so far, because there are mechanisms that are meant to make the government controlable and accountable for their actions. "Let's lock up people indefinitely and not offer proof and explanations for it" does not qualify as a democratic mechanism. The scary part comes from the insinuation that they will carry on certain practises within a new legal framework. I.e. They're not actually closing Gitmo (because they have literally nowhere to put the prisoners... no state will take them... and they don't want to let them go)... they're going to rewrite the letter of the law so that holding people there is no longer a crime.

It's all pretty shady to me... I think Obama actually genuinely wants Gitmo to close, but he can't be seen to just let the "enemy combatants" go free and there is nowhere else to put them, almost every state has registered it's "Not In My Back Yard" opinion, so he's being forced to make the current situation legal.
