I think what's important here is the potential for a undesirable outcome, no matter how unreasonable. Kilo, I would do as others suggest and just remake the piano notes in a similar, but different enough composition in order to avoid any possible bs. The band sounds like aholes anyways, you sure you even want to use their music :) You sure you even emailed the actual band members? Or was it possible just someone with an "Unofficial" fan-site.

On a practical standpoint of what's actually done varies like anything in life. Dr Dre and Eminem have been sued a few times for illeagal sample use as with some others on the hip hop scene. The Amenbreak was sample from an old record Amen Brother as I'm sure many of you already know and those guys to this day didn't receive any royalties from sample companies or artists but this was basically coz they didn't give a shit or quite possibly they didn't know about it which I'm sure could have been a different story if they were asked for permission.

There is legal sampling yes that is correct but we aren't talking about that are we, so there's no need to do the "haha you just said dick when you said dictionary" bullshit, you know I'm talking about commercial track here so let's not go down that path.

You say I'm talking laymans but then you say that if its going out for free its probs not worth it etc. Well I was talking about the actual law here not what 'might happen'. Yes it is a civil matter which means its easier to be prosecuted as its not a criminal matter which is basically 'innocent till proven guilty'. Before you argue with me on this just atleast take a minute to look into it as there's a massive misconception on criminal and civil laws.

I'm not sure if your on about the amen loop here? But if you are, then yea I know its copyrighted that's why I mensioned it? I'm not sure what your point was but I was saying that its a copyright protected piece that's been sampled a shit load and still they have never been paid royalties or sued anyone.

anyway, ive heard nuff tunes where people sample bits from films, other artists, etc... for fuck sake even the amen break has been used by countless producers over the years.... so how do they not face fines, do they get permission? or pay the licincing fees?? i think not.

so is there a way round this? does anyone know enough about copyright & such to offer me some good advice?

im thinkin now i shouldent of even asked, and they would prob never be none the wiser.

Also my mate was on about something in the news a while back that make it ok for us in the UK to use samples & stuff found on youtube videos in our productions... i didnt see it and he cant remember esactly, does anyone kno anything about this??

I'd just release the track mate. Give it a bit of time, and then go for it. I doubt a Goth band from the US is very much in the know about happenings in the UK bass scene. :W:

Ive had two run ins with copyrights and alike.

1. stole a vocal off something, asked the band, they asked for some reeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeeediculous fee. Rerecorded the vocal with a singer, used it and the band had to deal with it.

2. had a very small man from the most famous dubstep radio station threaten to come and beat me up over something an artist on the label had used. told to go fuck himself. MAKING FRIENDS YO. Couldnt sell the tune digitally which was very annoying.

Use everything, don't give a shit about anything, sample whatever.
