Is it it warez if the company is dead?

I was looking for a filter on KVR, something small and different, and came upon Frantic Filter by Basement Arts and went to the website to check it out, and the website was dead. So, thinking that maybe they might've moved locations, I googled Frantic Filter VST and a few *ahem* sites came up. I read about it and figured it was the only demo I could find so i torrent it, and found it amazing, fuck it, I'll buy this. But I cant buy it anywhere! And Basement Arts is no longer in the biz! So, can i keep it in good conscience, with the company defunct?

I woulda used it anyways, its really an awesome filter, so many routings crazy! I cant even think of a filter thats like it today!

I have to be honest...if Logic 5.5 was a stable program I might actually consider use it.

well theoretically it would be classified as 'warez'. the company is dead, the product is no longer available, but it has never been released as freeware. on the other hand, even if using it is illegal... there's no one left to sue you for it.

Yes this filter is badass. LFOs, 8 different routing slots, its really intense. Its modeled after the Korg MS20, Oberheim Xpander, OSC Oscar, Sherman Filterbank and Moog Filters (Yes that many diff filter types!). From what i can tell BA stopped making it in 2006. This is truly amazing. Of course if you can live with yourself....

That makes me sleepy just reading the thread! Holy Christ! Who even has that kind of time to detail all those filters like that? And ultimately it seems to come down to whats pretty much known, tatse. If you like that way xfilter sounds, use it!

I think Sylenth's filter is one of the best sounding vst filter's I've ever heard, though it's attached to the synth. Think Arturia's minimoog filter sounds pretty good too.

If you go to that gearsluts thread, download all of the tested files and listen (remember to check like types, No res with No res, Res with Res. I'm very pref to AD's Dr. Device, at 3pole/500hz its just nice and thick with little if any distortion. Its a good run-through of filters, can be an argument breaker too! The Frantic Filter sounds thin comparatively, but its not horrible, specially being technically free...

Yeah technically it would still be illegal as the copyright is still alive even if the company is not, similar to when an artist dies, their music or artwork doesn't automatically become public domain. With abandonware as mentioned it's a grey area really, as with artist copyrights there is an estate that holds the copyright after the death, with companies, anything could have happened... shame, they seem to have been making some nice software.
