Cannot make them cease and decist. By law you can produce a derivitive work as long as the original author gets a cut, which is usually negotiated previous to the track's release ->Unless of course you make underground electronic music :P

If money is made on it, Metallica can:

A) Sue for a percentage if the sample was not cleared.

B) Get their due if the sample was cleared.

Considering Lars is a crybaby who blames Napster for their bands decline in popularity, if enough loot is actually made on the track, I could see Metallica sueing....

This depresses me a bit. It's all money, and legality. It's not as if you could even recognize straight away that Saxon had sampled Metallica...it's just a bit harsh, brah.
dude, i noticed the first time i heard it. it's pretty blatant. i could care less though!

this is not the first time a big band has been sampled on Ram. ever heard the tune subfocus- x-ray?
X-ray is a bit different though... he didnt straight sample it, just stole the bassline melody and guitar chug pattern from that certain song (I wanna see if anyone else noticed the song as well).

No hate on C&S for that one from me though, i like what they did with it - it took me two or three times hearing it to fully get that it was 'Where ever I may roam', but I caught it was familiar from the first time I heard it.

Is that a sample for sure? I just listened to it again... that could have been recreated in a similar manner to the X-Ray thing.

As a producer, always ask if a tune is worth sampling, isn't it also worth leaving it alone? I can almost forgive Saxon tbh, it's pretty obvious the melody is Metallica... Eastern Jam, the entire damn tune revolves around the sample though. Without that sample, it's a grinding bassline and not even a good one. It makes the entire tune. Without that sample, that tune sells jack shit. Truth.

If they'd have pressed up 500 copies, broke even and made just a little scratch on the side, I'd have no issues with it whatsoever... they sold mad copies of that release and they made a ton of money without licensing the sample... once you're releasing records that sell on that level I think you have a responsibility to clear a sample. Thing is, they couldn't clear that sample because they lifted the entire damn track and renamed it, adding a bassline. It's not artistic license or fair use in that case, it's blatant theft. Like if I come up, steal your car and use it to launch my autoracing career.

And to then threaten other producers who would then do the same thing? You gotta be out of your mind.

Are you asking for a youtube link to The Number Song?! Dude, I think you just need to buy the album. I thought everyone had Endtroducing?!?!

He samples the bassline from Orion. And it's a proper, creative bit of sampling, not like the blatantly obvious lift from Chase & Status...

i never even noticed that song being sampled in the number song
though it was always my least favourite track on the album, its still a sick track

I am not disagreeing necessarily but if we are going to hang chase and status for this then there are a lot of other people waiting on death row. When you have millions of dance tunes that are all based off of one chord each shit is bound to overlap. Having legit morals and being into dance music at the same time is a tough thing to do. I rip shit off all the time. That is what a sampler is for and that is what I use it for. Fuck it. Sue me.
