Credit where credit's due I reckon. In my opinion samples should be cleared for release. In situations where they aren't cleared (whether the original artist/estate just says no or wants too much or whatever), then no-one should be officially credited for any releases (white label). As for "Alicia", it looks like Mala has taken the moral high ground by not taking official credit AND giving Ms Keys partial credit... The man may or may not have uncleared samples in his proper-release material, but in this case, methinks he did the right thing. The holy water tune on the other hand, is morally unsound, whether or not it is good music... For me (a so-called musical artist with zero releases) the credit thing is much more important than the money/royalties thing. On the other hand, I own lots and lots of proper-release hip hop and jungle, lots of it include a little drum break from an old funk tune which has "brother" in the title. I heard that the drummer from the band who released that tune died last year, broke and homeless. Who are we to say what's right or wrong?

Can anyone verify that Mala DIDN'T clear the sample for release?

Thanks for the lol Func. My copy of "in luv" is a white label, and as for "Ancient Memories", I did mention that Mala may or may not have uncleared samples in his proper releases. So yes, he may be just as much of a plagiarist as you, me or any big name producer. The gist of my post was that (in my opinion) in the case of "Alicia", Mala "did the right thing" whereas in the case of "Holy Water", Game and/or his producer didn't. In saying that, I am certainly unqualified to say what is right or wrong, and will not be casting stones, 1st or otherwise. Unfortunately, not much of what we say here on DSF has any bearing on whatever happens in the real world of music sampling, and I continue to be saddened by the fact that apparently the drummer for the Winstons never saw any reward for the hundreds if not thousands of tunes out there that sampled "Amen, Brother", credited or otherwise...
