there's actually a huge difference. a federal injunction+authorization for action on that level would be a massive and costly step wrapped up inside of a PR nightmare, especially on a general ballot issue that gets the popular vote across multiple states. it would get the issue out into the open for the first time and they couldn't ignore it anymore.
the situation under a 2nd term Barry would be infinitely better than a 1st term Mitt

early votes and districts pools are counted as votes are received, so the short answer is yes
however, they call the election before they've even counted all of the votes in a couple of different ways, both on the local level (districts) and state level (electoral college), so there will be a winner before all of the votes are technically counted (can go into a recount if things get extremely close)

Sure, but when you consider the ways most of the swing states are leaning, Obama pretty much has shit on lock
Wisconsin was called for Obama, without that Romney really needs to get Colorado, which happens to be leaning moderately to Obama
Without those two it's EVEN more difficult for Romney to hit 270 than it already was. Factor in the fair lead Obama has in Ohio, and it's looking really solid. Plus California which is an instant giant boost
Not to mention the tiny lead Obama has in Florida, which he doesn't necessarily need (but Romney almost can't win without at this point)
