What do you do if someone steals your DJ/Producer name?

from what ive learned there is a dj from london who has recently changed his name to the same as mine, i keep hearing bookings for nights with him on but he only changed his name early 2009, and i been using Rusha for like 2 years now,so in theory can i do him for liable or slander or something?

just the thing of if he plays a shit night or like smacks Dj hype or summat thats my rep right there.

what should i do?

any serious advice would be good

send him a message on myspace or something?

i'm sure his pride of knowing someone else had his name before him would take over.

Make a request, show him a flyer you've been on before him, or where you've used the name. Once you use it, it's yours if you were the first. Ask yourself if you were the first though, Rusha could be a common DJ name maybe...

After asking, Demand.

If that doesn't work, and it's worth it, pursue legal action.

its not really a problem, most people know the difference, considering i dont currently dj aswell, but i am starting to do a few things under another name too

Haha yeah. My name from the 90's was pretty obvious and there was a dj from just about every genre using the name. Had to let it go. Not that my current name is original but at least it isn't taken by everyone already.

I have experience of this.... the story is all pretty longwinded as these things tend to be, but i'll do my best to keep this short and to the point.

I was using the name 'ZILLA' ( http://www.discogs.com/artist/Zilla?noanv=1 )for deejaying / recording and had a few things out, some of them on pretty decent labels too. I was in the early stages of talking to a U.S label about putting an EP and the owner mentioned a band over in the states who had started using the name, they were getting a bit of press in certain areas and the chap was now worried about the confusion releasing the Ep in the current situation would lead too.
After looking in what they were about (and noticing a HELL of a load of things i'd done contributed to them... including like iTunes) I tried contacting them. They were really flakey, and insisted that as their name was Zilla and not 'ZILLA' it was a completely different name and wouldn't be an issue. They also confirmed they started using the name after my first release (which happened to be in the U.S). I told them their thoughts on the name was bullshit... i couldn't start a band called 'THE ROLLING STONES' and get away with it. After repeatedly emailing them and threatening all sorts of legal shit (i had also my publishing company looking in to it for me and contacting them on my behalf) the guy who was wanting to release my EP told me that asides from taking them to court there was nothing i could do. Even if i won i'd have to pay my costs.. that'd be a hell of a lot of cash to protect a stupid name. So...
I just had to pick another name and move on really. Fortunately i was in the position that i had a number of releases lined up which would help cement the new name.
It isn't / wasn't an ideal situation but really there isn't anything you can do besides ask them to stop using your name.

same issue wit me. been running camo since 97. now some kid in austria who skates better than me is making dnb, n some other kid in nz is mc'ing. so im changing my name to camo-tree. plus i have a load of smif'n'western n bounty killa. not really much you can do
