I have been trying to determine a production name and I have a few ideas. I did a quick Trademark search and I am clear, however, 2 of my 3 contenders there are bands internationally with that Myspace Profiles, and the 3rd contender there is just some random dude w/ that Myspace profile.

I know that legally I am in the clear, but what you let someone else performing under the same name or someone else having the Myspace name stop you from using it for yourself?

If you have a registered trademark, you can legally send them cease or desist notices and enforce them. Just because they have a registered Myspace profile means nothing legally.

For a while, I was one half of a hip hop due called Kidz on Fire. Someone else already had registered the myspace, but I managed to blag him to allow us to use it instead of him! You may be able to do the same with the random dude.

Regarding the two bands, you need to evaluate how big they are and whether any confusion will arise from the similarity in name amongst journalists and fans.

Another thing to consider is whether you can register the .com? .co.uk, .net & .org fail imo. If you can't get the .com, then I'd think up of another name. Further to this, are the Facebook and Youtube profiles available still?

In summary, if you own the registered trademark, have the .com and all the important social networking sites covered, then I'd get on Myspace's case to get them shut down for you. At the same time, you need to be realistic about how big you are, and how much promotional content you will be creating to support your music.

to answer your question though, yes it would stop me from using that name!

aside from any issues of copyright or just old-fashioned confusion, I'd say that if all 3 of yr shortlisted names have already been used by other artists then its probably a sign u need to start thinking a bit more creatively: in 10 yrs time u'll regret being called DJ Damage or MC Fire or some other banal shit, believe. no one remembers that stuff, better 2b called Peanut Butter Wolf any day, no matter how ridiculous

I made the huuuuge mistake of calling an electro collab neon. very good to make sure if someone googles your name only you will come up, or at least be the top find. With the electro thing we had to first change it to neOn, which didn't work too well and finally neON! Pain in the ass and involved many phone calls to distributors, labels, and beatport anytime we had a tune released. neon/neOn/neON! is no more thank fuck and my new name is stupid, Darkartois, no real meaning except I love nighttime and a good pint of Stella but I turn up in Google first =)

I thought I was relatively safe with "Mad EP"... though shortly after I started playing regularly in NYC I found out that there was a dj by the name "Matt EP"... it didn't help that he spun music quite similar to what I was writing at the time and were in some of the same circles... and that we both had chosen our respective names for the same reason: we are both named Matt P. (my surname is Peters, I don't remember his)

It ended up working out though- I was playing 3 or 4 times a month and he only spun a few times a year. After some initial confusion, people figured it out. I've seen a few other "DJ MATT EP"s sprout up- I think there is one in England... and another one in the States as well. Hasn't really been a problem, but just goes to show that even esoteric and obscure names can crop up a few times.


Oh- and for the record... Peanut Butter Wolf is the best name of all time.

dude you fail at names LOL and no, i would never release as something as generic as Ketamine... its just for DSF LOL

yeah man dont be choosing a name that a hundred other people have got, i found this name while i was doing a report for school when i was younger, trying to sound clever i was finding different words for things in a thesauraus - from what i can see theres no other dj's or producers with this name and if someone started using it i wouldnt think twice about roasting them for it.

Get a thesauraus out and get something thats personal to you!
